Rory McColl, 37, travelled to Bangkok on 9 March 2026 for a holiday, but found himself in police custody just hours after arriving in the country.

The father-of-one, who works at Buck’s Bar in Edinburgh, maintains that the incident was an honest misunderstanding after he accidentally picked up another patron’s handset from a bar counter, believing it to be his own.

“Rory was arrested on the first night of his holiday due to a misunderstanding. At some point, he went to get his phone, couldn’t find it in his pocket and saw the same phone as his sitting on the bar. He picked it up thinking it was his and put it in his pocket.”

As reported by Ryan Carroll and Joe Smith of The Mirror, McColl owned up to the confusion immediately, but local authorities taken him into custody and held him in a police cell for two nights under what his family described as “horrendous conditions”.

To secure his release on bail, McColl was required to pay £1,000, whilst Thai officers confiscated his passport, effectively preventing him from leaving the country.

What details were revealed about the incident and legal complications?

As reported by Matthew Fulton of STV News, CCTV footage from the venue shows security staff searching McColl for the phone, while the female owner appears to confirm the device belonged to her.

McColl has since stated that the woman involved contacted him directly to acknowledge that the incident was an unintended misunderstanding.

Despite this, formal legal proceedings continued through the Thai court system. McColl’s family reported additional anxiety caused by legal representation issues during his initial court appearances.

“They met at the court and he said to Rory, ‘This isn’t a good day, it’s a bad judge, he will send you to jail’. That petrified Rory. He would fast-track him for more money, and Rory gave it to him. We started to suspect if the guy was really a lawyer, as nothing was moving.”

— Helen McColl, Mother of Rory McColl

Following these concerns, the family sought alternative legal counsel to represent McColl during subsequent hearings.

How has the family responded to the ongoing ordeal?

Relatives in Scotland established a GoFundMe fundraising campaign to assist McColl with mounting living costs and legal charges in Thailand.

Because standard travel insurance policies generally do not cover extended hotel stays or legal fees resulting from criminal proceedings, McColl has had to fund his prolonged stay in accommodation in Pattaya while awaiting trial dates.

His sister, Joanna McLaughlin, publicly expressed the family’s distress over his separation from his son and his job, as well as the prospect of jail time in facilities such as Klong Prem Central or Bang Kwang Central prison.

A spokesperson for the Foreign, Commonwealth & Development Office (FCDO) confirmed that officials remain in contact with local authorities and are providing consular support to a British man in Thailand.

Background of the particular development

Legal procedures involving foreign nationals in Thailand strictly adhere to the Thai Criminal Code, under which theft offences carry potential penalties of imprisonment or fines, regardless of whether the property was returned or whether the accused claims a lack of criminal intent.

Under Thai law, once a formal complaint is registered and processed by the police, criminal charges are prosecuted by the state rather than individual complainants, meaning an informal resolution between the involved parties does not automatically cancel court proceedings.

For international tourists, criminal investigations in Thailand regularly involve the seizure of travel documents, mandatory bail conditions, and multi-month delays between initial arraignments and final judicial rulings.

During this interim period, accused individuals are prohibited from departing the nation, placing extended financial burdens on visitors who must self-fund accommodation, legal representation, and living costs while navigating foreign language court systems.

Prediction: How this development can affect British tourists in South-East Asia

This development highlights the operational and financial risks facing British tourists travelling to South-East Asia, particularly regarding minor legal disputes or accidental property mix-ups.

The situation demonstrates how quickly an unintentional error can escalate into a lengthy legal process involving passport retention, court appearances, and substantial unplanned costs.

For future travellers, this case underscores the strict enforcement of local theft laws in Thailand and the limit of standard travel insurance policies, which rarely cover legal defense or extended accommodation during criminal investigations.

As a result, tourists may exercise greater caution in public venues with personal belongings and seek immediate advice from embassy or consular officials when faced with local law enforcement enquiries.
